The terms and conditions governing the CITB website
The CITB website terms and conditions are effective from 31 January 2018 (ref: V2.1 Website T&Cs).
The Construction Industry Training Board otherwise known as CITB is a charity registered in England and Wales (Charity Number 264289) and in Scotland (Charity Number SC044875) with its principal place of business at Sand Martin House, Bittern Way, Peterborough, PE2 8TY (“CITB”).
Reference to ‘you’, ‘your’ and ‘yours’ are references to the persons accessing the Site. References to ‘we’, ‘us’ and ‘our’ are references to the Construction Industry Training Board.
www.citb.co.uk and any other website owned or operated by CITB (hereinafter referred to as ‘the Site’) is maintained for your personal use and viewing. Your access and use of this Site constitutes your acceptance of these Terms and Conditions which takes effect from the date on which you use this Site. If you do not accept these Terms and Conditions you are not authorised to use or continue using the Site.
We may at any time revise these Terms and Conditions, in whole or in part, without notice. Please check these each time you use the Site. You agree to review the Terms and Conditions regularly and your continued use of this Site following the posting of any changes will signify your acceptance of these changes.
Access to the Site is on a temporary basis and we reserve the right to amend or withdraw the service without notice. We will not be liable if for any reason a Site is unavailable at any time and for any period.
These Terms and Conditions are to be read by you together with any terms, conditions and disclaimers provided in the pages of the Site. In the event of any conflict, the terms and conditions and disclaimers provided in the pages of the Site shall prevail over these Terms and Conditions.
You are not entitled (nor will you assist others) to set up links from your own websites to the Site (whether by hypertext linking, deep linking, framing, tagging or otherwise) without the prior written consent of CITB, which we may at our absolute discretion, and without providing a reason, grant or withhold.
Where a Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
The contents of the Site are protected by copyright, trademark rights, database rights, patent rights, design rights and any other text, graphic, audio, video or images, contents, software, data and information. You may print, copy, download or temporarily save extracts from the Site only for your own personal information.
We allow you onto this Site in return for you agreeing not to adapt, alter or create any derivative work from any of the material contained in this Site.
The names, images and logos identifying CITB are registered trademarks. The copying and use, in any manner, of the CITB logo, name or images is not permitted without prior written consent of CITB. You can request permission to use the CITB logo by writing to Communications & Marketing, CITB, Sand Martin House, Bittern Way, Peterborough, PE2 8TY or by email to marketing@citb.co.uk.
All other trademarks, brand names, product names and titles and copyright used on this Site are used under licence granted by their respective holders. No permission is given by CITB in respect of the use of any of them and such use may constitute an infringement of the holder’s rights.
If you print off, copy or download any part of the Site or breach these Terms and Conditions, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
However, research reports and/or materials may be able to be downloaded from the Site, subject to specific terms and conditions. Please refer to the copyright wording and terms set out relevant to each particular report or set of materials.
Use of the Site is at your sole risk. The material displayed on the Site is provided without any guarantees, conditions, or warranties as to its accuracy. CITB shall not be liable for any direct, indirect or consequential loss or damage incurred whatsoever and howsoever arising as a result of your use, or inability to use, or reliance on the information on the Site, or any website linked to it, to the maximum extent permitted by law.
Further, CITB will not be liable for:
- The accuracy or reliability of the information or content of the Site;
- Problems including compatibility and damage or corruption of your hardware, software or installation;
- The security of the Site;
- Interruption in availability or errors of the Site;
- The Site content failing to meet your requirements; or,
- The accuracy, functionality or performance of any third party software that may be used in connection with the Site.
The Site is intended for those who access it within the United Kingdom. We cannot therefore guarantee that the Site and its content comply with or are suitable for use in other places. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with local laws.
Messages sent over the Internet cannot be guaranteed to be completely secure as they are subject to possible interception, loss or alteration. We are not responsible for them and will not be liable to you or anyone else for any damages or otherwise in connection with any message sent by you to us or any message sent by us to you over the internet.
We are concerned about the safety and privacy of our users, particularly children. Parents/guardians who wish to allow their children access to and use the Site should supervise such access and use. By allowing your child access to the Site you are allowing your child access to all services including email, forums and/or other message or communication facilities. It is therefore your responsibility to determine which services are appropriate for your child.
CITB may maintain on the Site a registration questionnaire that allows individuals to submit details in order to be considered for registration with CITB.
Registration with CITB is a statutory obligation on an establishment that meets criteria set out within the relevant legislation. The decision whether to accept the registration questionnaire rests with CITB and may be subject to further enquiries.
By submitting information on the registration questionnaire you understand and accept that the establishment may be liable to be assessed to annual levy with no option to withdraw so long as the statutory criteria applies.
From time to time CITB may run competitions, free prize draws and promotions on this Site. These will be subject to separate terms and conditions made available at the time of such promotions.
This is subject to additional terms and conditions that are available from CITB Publications.
Whilst CITB makes all reasonable attempts to exclude viruses from the Site, it cannot ensure such exclusion and no liability is accepted for any loss, disruption or damage to our data or your computer system which may occur whilst using material off the Site.
You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the site is stored or any server, computer or database connected to the Site. You must not attack the Site via denial-of-service attack or a distributed denial-of-service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.
You have sole responsibility for adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for computer viruses or destructive properties. Thus, you are recommended to take all appropriate safeguards before downloading information from the Site.
CITB is not responsible for the contents or reliability of any other websites to which we provide a link and does not necessarily endorse the views expressed with them. Listing should not be taken as endorsement of any kind. We cannot guarantee that these links will work at all times and have not control over the availability of the linked pages. In particular CITB is not responsible for any privacy policies on external websites and we recommend you read the relevant statements on any other website you visit. CITB is not responsible for the direct or indirect consequences of you linking to any other website from the Site.
We process information about you in accordance with our Privacy Policy. By using the Site, you consent to such processing and you warrant that all data provided by you is accurate.
These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales and the English and Welsh Courts will have exclusive jurisdiction in respect of any dispute which may arise although we retain the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant Country.
